I read recently how a station in Brattleboro, VT dumped Rush and replaced it with Air America and even some ClearChannel stations will soon be doing this.
Travis County - location of wonderful Austin, TX. - is a blue county. Why is Rush on the air here on KLBJ 590 AM?
We can change this. Here's how:
1. Write an email to KLBJ and ask them to Crush Rush and pick up Air America.
2. Write a letter to the Editor of the Chronicle
and urge readers to contact KLBJ (include contact info
from the KLBJ link, above). Make sure to read the Chronicle's instructions. You have to include your address and phone number in your message. If your letter is published, you can edit what will be revealed.

The following is an e-mail I sent this to FCC Chairman, Michael Powell on January 24, 2005. It's about Randi Rhodes Air America show being dumped on Fridays because she uses the word "bastard"

Mr Powell-
It has come to my attention that a radio station is in fear of fines from the FCC if the word bastard is said on the air. The three prong test to define obscenity as defined on the FCC's web page is the following--
An average person, applying contemporary community standards, must find that the material, as a whole, appeals to the prurient interest;
The material must depict or describe, in a patently offensive way, sexual conduct specifically defined by applicable law; and
The material, taken as a whole, must lack serious literary, artistic, political, or scientific value.
I have looked up the word bastard and its most extreme meaning refers to the marital status of ones parents, not to a sexual act. I am asking you if the word bastard can be construed as sexual conduct.

I am disappointed to hear that you will not air the Randi Rhodes program this Friday because the word bastard is part of the broadcast. I can understand your fear of being sued by the FCC, but I looked up the FCC rules and I believe you are incorrect in your decision.
There is a three prong test for materials to be defined as obscene by the FCC. One of those prongs as described in your e-mail is-- the material must describe sexual or excretory organs or activities.
Just to make sure, I looked up the word bastard, which is the word in question on the Randi Rhodes program. Bastard at its most extreme meaning refers to illegitimacy. This is a definition of the marital status of one's parents. It does not refer to any sexual act.
If your position is that the act of birth by unmarried people infers a sexual act, then it also follows that it is obscene for anyone to mention anyone else's parents. With the exception of Mary, mother of Christ, that would make all parents obscene.
Again, I ask you to have the courage to air the Randi Rhodes program. If you are worried about possible consequences, ask the FCC for a ruling on this word. Or forward my e-mail to the FCC. I suggest that as they have promulgated the rules, they are therefore required to give you an interpretation. Simply ask them if the word bastard describes sexual or excretory activities. Then you will know.

Robert,
We won't air Randi Rhodes Friday program.
If we are in error, we are forced by circumstances and the Government to stay on the safe side of this issue. The FCC is totally unpredictable with it's rulings regarding broadcast standards. The FCC changes it's position with new court rulings, legislative initiatives, and changes in administrations.
Through all this, we must walk a tight rope of regulations to protect the license of KCAA. If one person files a complaint about Randi Rhodes, as several KCAA listeners have threatened, the FCC will issue a letter of inquiry which basically calls upon KCAA to prove it did not broadcast indecent programming. If the FCC decides the programming was indecent, the station gets a fine and the issue will weigh against KCAA at license renewal time. Here are excerpts from the FCC website.
It is a violation of federal law to broadcast obscene, profane or indecent programming. Congress has given the Federal Communications Commission the responsibility for administratively enforcing the law. In doing so, the Commission may issue a warning, impose a monetary forfeiture or revoke a station license for the broadcast of obscene, profane or indecent material.
Obscene speech is not protected by the First Amendment and cannot be legally broadcast at any time. To be obscene, material must lack serious literary, artistic, political, or scientific value or the material must describe sexual or excretory organs or activities.
Here is the big "catch all" language.
In applying the "community standards for the broadcast medium", the Commission has stated, "The determination as to whether certain programming is patently offensive is not a local one and does not encompass any particular geographic area. Rather, the standard is that of an average broadcast listener and not the sensibilities of any individual complainant.
Here is the practical application of this language. The FCC can receive a complaint against Randi Rhodes on one station and levy a fine against all the stations that carry the Randi Rhodes program. In one recent case, the FCC fined 169 stations for complaints it received against one network program. Upon review, it was discovered that 159 complaints had been filed however, all but three complaints were duplications filed by the same group.
When this was discovered, the "The Parents Television Council", the PTC for short, hit the Commission with 4,073 member complaints and called for a congressional investigation into the FCC's complaint counting process.
In this political environment, it is impossible to know how the FCC will react to complaints about Air-America. Since Air-America is known to be anti-administration, tolerance and forbearance toward Air-America should not be expected.
Also, the largest group owner that broadcasts Air-America programming is in fact, the largest group owner of radio stations in America which of course is Clear Channel Communications. It is no secret that Clear Channel has very deep pockets so the FCC could levy a fine for hundreds of Thousands of Dollars per station against Clear Channel and collect from the giant broadcaster without a problem. Compare this to our independent operation here at KCAA that would be forced to sell out to CC or another group if it were faced with a huge fine.
It should be emphasized that Air-America holds no FCC license and controls no over-the-air frequencies. Therefore is not regulated by the FCC. So, it is KCAA Radio that is responsible for everything Air-America broadcasts on KCAA.
Moreover, it must be recognized that free, "over-the-air" licensed broadcasters have less First Amendment rights than subscription TV cable or satellite radio broadcasters. From the viewpoint of the Government and the FCC, cable and satellite services are paid services that you choose as a consumer and you pay extra to see and hear.
This difference has allowed the Government to impose itself upon and, subvert the Constitutional rights of licensed broadcasters and the programs that air on all licensed over-the-air stations. This difference gives Government the excuse to control, restrict, and penalize broadcasters and to ignore the real power of the consumer, the power to simply change the channel.
Lastly, and most importantly, we value you as a listener and want to keep you as a listener but we need you to understand that we are really getting pulled in two opposite directions. The FCC has the proven ability and willingness to create and destroy. With all due respoect, we know the rules much better than our listeners who have no responsibility to help us after we make a mistake.
